Special KHA Town Hall – Loper Bright and the post-Chevron Age

Join KHA on Thursday, October 3 at 10:00 a.m. ET for a Special Town Hall on Loper Bright and the post-Chevron Age – An Overview for Kentucky Hospitals.

On June 28, 2024, the U.S. Supreme Court abandoned 40 years of caselaw when it overruled the Chevron doctrine in Loper Bright Enterprises, Inc. v. Raimondo. The Chevron doctrine allowed administrative agencies to enjoy a level of deference when agency regulations were challenged in the courts, but Loper Bright directs federal courts to exercise their “independent judgment” when determining whether an agency acted within its statutory authority. The impact of Loper Bright will be felt by every federally regulated industry in the United States.

This presentation will provide a short overview of how Loper Bright has changed administrative law in the courts and will discuss how Kentucky health care providers may need to adjust to the new legal landscape.
